Indore: High court has disposed a contempt petition seeking formation of ward committees in Indore, on the grounds of petition being infructuous.IMC submitted before division bench of Chief Justice and Justice Vivek Rusia that ward committees were constituted in October 2017. The petitioner argued for election of committee president, as mandated by the constitution. However, IMC argued that the court order passed earlier for formation of ward committees did not have directions for conducting elections of president and hence, there was no contempt of order by former IMC commissioner Manish Singh against whom the petition was filed. The court disposed petition based on arguments of the IMC. However, also granted liberty to petitioner to file a separate writ petition seeking elections for the post of president.“According to the constitution, the ward committees comprise corporators whose wards fall within the zone and two elderly men for each committee. In Indore, 22 ward committees have been notified by IMC, and for them, 44 elderly men also have to be appointed. From among these members, the president of each of this committee will have to be elected which has not been done by IMC yet,” advocate Mahonar Dalal, counsel for the petitioner Dilip Kaushal said. The ward committee is a constitutional body which holds many powers including financial powers, approvals for demolitions and other such activities. These powers rested with IMC commissioner in absence of the committees. After merger of 29 villages in Indore limits, the total wards in the city have gone up to 85, making the number of ward committees - 22.
