Custodial death case: HC asks CID to submit investigation report

In the last progress report submitted by the CID in June 2018, it had been claimed by them that the case did not attract Section 304 of IPC as the death was suicidal and not homicidal. The judicial inquiry report had also held that the postmortem had not been done properly . Mishra submitted before the court that they were carrying out the investigation in a speedy manner and a report will be submitted by them.“The court directed investigating officer to submit the final report in four weeks,” advocate Gagan Bajad, counsel for the petitioner said. INDORE: The Indore bench of Madhya Pradesh high court on Tuesday granted a last opportunity to CID to submit final report of investigation being carried out by them in custodial death case of court employee Pankaj Vaishnav at MIG police station.The then police station in charge MA Syyed along with two others are accused for culpable homicide of the court employee who was found hanging by a shoelace in the police station’s bathroom.Justice Rohit Arya on Tuesday had summoned investigating officer in the case Pawan Mishra and questioned him about the delay in completing investigation of the case. CID had submitted records including DVD footage, photographs and other details of the deceased court employee’s body to a team of doctors at Bhopal , who had concluded that death was caused due to hanging and hence was not homicidal.However, the inquiry held in the matter earlier by additional chief judicial magistrate in which statements of doctors had been recorded and recommendations were given, the ACJM court had clearly held that death was not suicide but was a case of homicide.
