Indore: The issue of a high number of cases being listed before each bench of the Madhya Pradesh high court following summer vacations was raised before the registrar general at Jabalpur by the Indore bar association.Following the discussion, a notice was issued by the Chief Justice where it was declared that only the fixed dated and mention memo cases (cases in which an application has been moved by either parties for hearing on a early fixed date) will be heard on the specific day along with urgent criminal cases. All other civil and criminal cases to be heard after notice will be listed only after two weeks."At the Indore bench around 400 cases were being listed every day for hearing at every bench which have to be heard within the six working hours of the court. This reduced the time allotted to each case as being less than a minute. Under such circumstances, neither are advocates able to argue the matter well, nor are the judges able to give sufficient time to each case," Anil Ojha, president of the Indore high court bar association said.Also, it has been mandated that bail applications freshly filed before the high court's principal seat and benches at Indore and Gwalior under sections 482 and 439 of CrPC will only be heard after the lunch break, i.e. post 2:30pm.In the notice issued by the Chief Justice regarding listing fixed dated and mention memo cases, it has also been stated that all civil and criminal matters to be heard after notice will be listed in suitable lots in coming weeks as per the availability of space.As the court will remain closed on Monday for Eid, the approximate number of cases listed before each bench on Tuesday has gone down to around 200 cases.
