CM, CS can't be held personally responsible for Mandsaur violence: State to HC

INDORE: There are no grounds on which chief minister Shivraj Singh Chouhan and his chief secretary SK Mishra can be made respondents in personal capacity in the petition accusing them of the violence, which took place in Mandsaur recently, the Indore bench of Madhya Pradesh high court was told on Tuesday during the hearing of public interest litigation.Additional Advocate General Sunil Jain argued on behalf of the state government before the court, submitting that Chouhan and Mishra did not take action in personal capacity and they cannot be held personally responsible for the violence unless proven in any investigation report.Both the names must be removed from the array of respondents in personal capacity, the state told the high court. The petition has been filed by advocate Yawar Khan on behalf of Awdhesh Bhargav. It alleges that all the respondents had committed murder by firing on the protesters in Mandsaur.The petition had also sought a stay on the chief minister's order offering Rs 1 crore to the kin of each deceased, who had died during the farmers' protest in Mandsaur. On this, the state said, the relief prayed for was infructuous as the amount had already been distributed."Another ground which has been raised by us is that already a committee has been formed for investigation in the case, hence all the reliefs prayed for by the petitioner are rendered infructuous. Also, since another similar petition has already been filed before the court, this petition must be dismissed to avoid multiplicity," said the additional advocate.The petition was heard on Tuesday by the division bench of Justice PK Jaiswal and Justice RK Dubey, who kept the matter under consideration.The petition also alleged that Secretary to the chief minister SK Mishra had given the orders of firing on the farmers to SP OP Tripathi. The state objected to this allegatin. It stated that such allegations were completely baseless and prayed for the dismissal of the petition.
