SC notice to Chhabra, wife, nephew on cheque bounce

"This order was challenged by the Chhabras before the high court, where it was allowed, and the proceedings of the trial court were set aside. Chhabra's wife Prabhjot Kaur admitted her liability to the bill.Thereafter, Rs 25 lakh were paid to the company. It was discovered that the bounced cheque was issued from the account of Preetam Singh, who was Pintu's nephew. It challenges the order passed by single bench of Madhya Pradesh high court and appealed for quashing of the proceedings against Chhabra, his wife Prabhjot Kaur and his nephew Pritam Singh at the lower court.

INDORE: The Supreme Court has issued notices to businessman Pintu Chhabra , his wife and nephew, over a bounced cheque given by them to a company for construction of a marriage garden.The bench comprising Justice AK Sikri and Justice Ashok Bhushan issued the notices in the special leave petition, returnable in six weeks.The petition has been filed by the United Project Construction Limited Company, through advocate Vivek Dalal. It challenges the order passed by single bench of Madhya Pradesh high court and appealed for quashing of the proceedings against Chhabra, his wife Prabhjot Kaur and his nephew Pritam Singh at the lower court. The trial court in June 2014 had issued notices to the accused finding sufficient grounds in the petition, where it was alleged that a cheque of Rs 2.9 lakh given to the petitioner company was dishonoured.The matter dates back to April 2000, when Pintu alias Gurjeet Singh Chhabra had asked the United Project Construction Company to construct a guest house at Karan garden. After completing the work in 2001, the company gave a bill of Rs 43.7 lakh to Chhabra for clearance. Chhabra's wife Prabhjot Kaur admitted her liability to the bill.Thereafter, Rs 25 lakh were paid to the company. Against the remaining amount of Rs18 lakh, a cheque of Rs 2.9 lakh was given to the company in August 2002 by Prabhjot Chhabra , which was dishonoured.The petitioners filed a case before the trial court against Pintu Chhabra and his wife. It was discovered that the bounced cheque was issued from the account of Preetam Singh, who was Pintu's nephew. As Preetam had not been made a respondent in the first petition, the case was dismissed.Following this, another case was filed before the trial court making Preetam as a respondent. In the case judicial magistrate Shailesh Bhadkariya issued notices to the Chhabras on June 20, 2014."This order was challenged by the Chhabras before the high court, where it was allowed, and the proceedings of the trial court were set aside. Against this order, the company has now approached the Supreme Court, seeking an interim stay on the operation of high court's order," said advocate Vivek Dalal appearing on behalf of the company.
