UDH dept seeks legal advice on ‘control regulation’ draft

JAIPUR: The urban development and housing (UDH) department will seek legal advice on ‘control regulation’ draft before its implementation. In the cities, that have a population of less than one lakh, these establishments will be allowed on 9 metre roads. “In the draft, population-wise, we have divided cities of the state in two categories. While, major cities, where population is more than one lakh, it would be mandatory to have 24 metre road to set up these commercial establishments. For the same, provisions for this purpose have been made in the development control regulations.

JAIPUR: The urban development and housing (UDH) department will seek legal advice on ‘control regulation’ draft before its implementation. After receiving a nod from the UDH minister Srichand Kriplani, the draft will be forwarded to additional solicitor general for approval.In the draft, many activities such as hotel, ATM, bank , dairy booths, gyms, marriage halls are categorised as commercial. In the cities, that have a population of less than one lakh, these establishments will be allowed on 9 metre roads. While, major cities, where population is more than one lakh, it would be mandatory to have 24 metre road to set up these commercial establishments. “In the draft, population-wise, we have divided cities of the state in two categories. Rules for cities that have a population of more than one lakh are stringent,” said an official.The official claimed, the proposed draft aims to unify development rules across all urban areas. Sources in the department said that this would expedite development work as it might save unnecessary legal complications for the state government and help to revise master plans.Sources further claimed, that the state government is seeking advice to regularise shops and offices in residential areas under the urban local bodies. For the same, provisions for this purpose have been made in the development control regulations. As the move is expected to benefit many commercial establishment owners, the state government is making efforts to implement them before upcoming assembly elections.“The proposed draft lets the government follow an existing master plan, or direct to prepare a fresh master plan under the provision of this Act and on and from the date on which the fresh draft master plan is published, such master plan or master development plan shall ceased to be in operation’, states the draft of the Regional and Urban Planning Bill. As bill was not tabled, zonal plans were prepared to expedite the process,” an official said.
