JAIPUR: Rajasthan High Court had commuted the death sentence of a rape convict of a minor to life sentence treating it not a rarest of rare case to warrant death sentence.The division bench of the high court issued the order on a death reference by the lower court. The court has sentenced the convict to 20 years imprisonment as per IPC and life sentence as per POCSO. The court had dismissed the petition by Pintu for cancellation of his sentence. Pintu was sentenced to death by special POCSO court in Alwar on May 9 this year for raping a seven-month-old. The court had also imposed a cost of Rs 30,000.The petitioner said the court while sentencing him had not taken into consideration his age or it does not come in the rarest of rare to invoke the provision of death sentence. Also, there is not enough evidence against the petitioner.
