HC vacates stay on appointment of grade III teachers

The court issue stay orders after some unsuccessful candidates approached the court seeking a normalization of marks scored in the REET held in different years. Deputy commissioner Panchayati raj Harban Meena said the concerned CEOs were directed to issue the appointment orders without delay. Jodhpur: In what can be termed a major relief for the successful candidates awaiting appointment to the post of grade III teachers, the high court on Monday vacated the stay on these appointments. “These 1,225 posts under TSP areas would remain subject to the petition. Since the issue belong to the appointment of elementary teachers which comes under the Zilla Parisahds, the concerned Zilla Parishad would issue the orders, he said.

Jodhpur: In what can be termed a major relief for the successful candidates awaiting appointment to the post of grade III teachers, the high court on Monday vacated the stay on these appointments. The high court had last week stayed these appointments seeking reply from the government about the appointments concerning the Tribal Sub Plan (TSP) areas.The division bench comprising justice Sangeet Lodha and justice Dinesh Mehta, while vacating the stay, has however, kept the 1,225 posts in TSP areas subject to the petition. “These 1,225 posts under TSP areas would remain subject to the petition. On the next hearing, the court will pass the order after submission of the plan regarding appointment in the TSP areas,” said petitioner’s counsel.It may be recalled that the court had stayed the appointment process of successful candidates for 26,000 posts in the state for grade III teachers. During the stay, government had already begun the process of appointments and many had already been given the postings before the order of the court regarding the stay was received by the zila parishads and communicated to the appointing authorities.With this order, now all those, who had their postings struck with the stay order, will now heave a sigh of relief and will soon get their postings. Petitioner Manish Kumar Nagda had stated in his petition that the government was not extending the TSP benefits to the candidates belonging from the new TSP areas in Pratapgarh, Udaipur and Sirohi, which had been declared as the TSP areas through a gazette notification in May 2018.Counsel for the petitioner, V S Rajpurohit argued that the government has been extending the benefits of TSP areas to the candidates in all the recruitments but not the candidates of these newly declared TSP areas are being deprived of the TSP benefits in the appointment of the III grade teachers appointment for TSP and non-TSP area candidates inspite of the directions of the high court.Zilla Parishad to issue appoinment orders:Following the lifting of the stay on the appointment of third grade teachers by the high court on Monday, the Panchayati raj department had directed the CEOs of the Zilla Parishad to issue appointment orders to the successful candidates.
