JAIPUR: A police constable who was denied benefit of second selection scale after he became father of third child due to the failure of sterilization was given relief by the Rajasthan High Court A division bench of the court asked on Friday the state government to grant him selection grade/promotion within a period of three months from the date of copy of the judgement.Bench comprising Justice Mohammad Rafiq and Justice Goverdhan Bardhar asked principal secretary, department of personnel, principal secretary, department of home, director general of police and commandant 13th Batallion RAC (jail security) to grant the due selection grade and promotion to the constable. Nathu Lal was appointed on the post of constable on March 29, 1995. The petitioner had his first child on July 11, 1997 and second child on April 18, 1999.“On December 13, Shanti, the wife of the constable underwent sterilization operation at government hospital, Dungarpur . Certificate was also been issued by the medical officer, government hospital Dungarpur. This was done to enable the couple to restrict the family up to two children. Thereafter, on June 20, 2001 the state government introduced amendment in the state services rules by promulgation of Rajasthan Various Service Rules. The same amendment was introduced in the Rajasthan Police and sub-ordinate service rules, 1999,” said Vigyan Shah, counsel for the petitioner told TOI on Saturday.The constable was surprised when his wife again became pregnant and gave birth to a girl child on March 31, 2003 despite a sterilization operation.
