Jammu & Kashmir becomes first state to criminalize ‘sextortion’ of women

The State Administrative Council met under the chairmanship of Satya Pal Malik, governor, and approved the “Prevention of Corruption (Amendment) Bill, 2018” and the “Jammu and Kashmir Criminal Laws (Amendment) Bill, 2018”. JAMMU: The State Administrative Council of J&K on Friday approved an amendment to the state’s Ranbir Penal Code, which will now criminalize the sexual exploitation of women by those in positions of authority, having a fiduciary relationship with the victim or are public servants.With this, J&K has become the first state to bring such a law on the statute books. The proposed bill will amend the Ranbir Penal Code, with a specific offence under Section 354 E being inserted to provide for the offence of “sextortion or exploitation”, the official spokesman of the state administration said.“Amendments are being made in Sections 154, 161, Schedule of Criminal Procedure Code, and Section 53 A of the Evidence Act, which will bring ‘sextortion’ on a par with similar offences prescribed under Ranbir Penal Code; also, an amendment is being made in the Prevention of Corruption Act to change the definition of misconduct and bring the demand for sexual favours at workplace within the meaning of Section 5 under the law,” the spokesman said.
