Dulal Bhuiyyan sentenced to 5-yr jail in DA case

RANCHI/JAMSHEDPUR: The special judge for CBI cases in Ranchi on Thursday sentenced former minister of revenue, land reform and co-operative Dulal Bhuiyyan to five years rigorous imprisonment in a disproportionate assets (DA) case. "However, I feel there could be political shades in my case," he told a group of reporters. The case was registered against Bhuiyyan in October 2013. It added that the charges were proved during the trial.Bhuiyyan's lawyer Anil Kumar Kanth said the court held him guilty and was sentenced him under Section 13 (2) o the Act. Bhuyyan said he had complete faith in the lower judiciary.

The court also imposed a fine of Rs 10 lakh on Bhuiyyan with the direction that he would have to undergo additional one year imprisonment in case of default in payment.Additional judicial commissioner Anil Kumar Mishra sentenced the former minister under Section 13 (2) read with 13(1) (e) of the Prevention of Corruption Act in the case bearing number RC 21A/2013.A CBI press release said the DA case was filed against Bhuiyyan for alleged possession of assets to the tune of Rs 86,10,745. It added that the charges were proved during the trial.Bhuiyyan's lawyer Anil Kumar Kanth said the court held him guilty and was sentenced him under Section 13 (2) o the Act. The case was registered against Bhuiyyan in October 2013. The charge-sheet was made in November 2014. During the trial, 21 witnesses each deposed from the prosecution and the defense sides.The conviction has apparently brought to end the 25-year-long political career of Bhuiyyan whose rags to riches story is no secret to the people close to him.The fiery Scheduled Caste leader who spent his early years of politics by taking part in the separate statehood movement of JMM in late eighties and early nineties, contested his maiden election during 1995 assembly polls in the erstwhile Bihar from the Jugsalai (reserved) seat and went on to defeat the sitting Janata Dal MLA, Mangal Ram, by over 40,000 votes.Since then, there was no looking back for Bhuiyyan who apparently was a rickshaw puller prior to his entry into active politics. He then went on to win the 2000 and 2005 Assembly polls on JMM tickets defeating Mangal Ram and Haradhan Das, who were fielded by BJP in the two subsequent polls.However, in the 2009 state elections, Bhuiyan lost the seat to his protege Ram Chandra Sahis, who was a block level JMM worker but was fielded by AJSU.Bhuiyyan, who was part of the Madhu Koda cabinet (September 14, 2006- August 23, 2008) holding the important portfolio of revenue and land reforms, continued to hold on to his ministerial berth in the short-lived Shibu Soren government (August 27, 2008 -January 18, 2009) that was formed after JMM withdrew support to the Koda government.Getting the ministerial berths was the peak of his political career and the turn of his fortune. However, with electoral losses in 2009 and 2014 and the CBI filing charge-sheet for amassing assets of over Rs 1.03 crore disproportionate to his known source of income in 2014, was the beginning of the end to his political career.The CBI had found three bungalows, six farm houses, five four-wheelers and Rs 40 lakh cash in deposits besides three sophisticated weapons in its investigation.In 2014, Bhuiyyan contested on a Congress ticket but couldn't manage to wrest the seat from AJSU even though he bagged a good number of votes.After the verdict, the former minister said he would file an appeal in the high court. Bhuyyan said he had complete faith in the lower judiciary. "However, I feel there could be political shades in my case," he told a group of reporters.
