Kerala high court junks plea against curbs, says no issues at Sabarimala

KOCHI: The Kerala high court on Monday dismissed a petition alleging restrictions on pilgrimage for BJP members, saying there were no issues at Sabarimala now and it wanted no protests there.No trouble has been reported from Sabarimala now and the court only desires that no protests are undertaken there, a division bench comprising Justice P R Ramachandra Menon and Justice N Anil Kumar said.The court was considering a petition filed by Vibin K V of Kanakamala in Thrissur and two others alleging that they were detained by police at Pamba while undertaking the pilgrimage and were forced to return as they were members of BJP.As per the petition, Vibin and two other BJP members were part of a 35-member group of pilgrims who departed for Sabarimala on November29. When they reached Nilackal in the afternoon, they were subjected to police checking and allowed to proceed to Pamba by KSRTC bus. Upon arriving at Pamba, they were again put to another round of police frisking, checking and questioning. They were asked whether they had any association with RSS or BJP or other organizations generally known as Sangh Parivar. While others disclaimed any association, Vibin and the two others honestly informed that they were members of BJP, the petition filed through advocate P Vijayakumar said.When police came to know that the petitioners took part in ‘Namajapa Ghoshayatra’ at Chalakkudy a few weeks ago and that a case has been registered by Chalakkudy police, they were taken to Perumpetty police station 60km away and detained for five hours. They were released upon executing some bonds and papers and were told not to go to Sabarimala during the current Mandalam season. They were forced to return home on their own arrangements, the petition stated while alleging that their right to worship has been denied due to highhandedness of police.The government informed the court that the petitioners went to Sabarimala in tune with a circular issued by a political party to create trouble at the shrine. Vibin is an accused in seven cases and another of the petitioners is an accused in two cases. They had to be blocked as they were not willing to cooperate with the police. There is no restriction in them taking the pilgrimage now, government’s counsel submitted. Based on the submission, the court disposed the petition.
