Justice Karnan refuses to vacate Kolkata flat

KOLKATA: Retired justice C S Karnan has told the state housing department and the registrar general of the Calcutta high court that he cannot be evicted from his Rosedale Complex flat at Newtown till his order against eight Supreme Court judges are not executed. The flat, meant for a sitting judge of the Calcutta high court, needs to be vacated. In a letter he has said that he wants to continue at the Rosedale complex flat as it serves as his residential place and “make-shift court”.The new chain of events, over the Rosedale complex flat where justice Karnan stays, started when the housing department sent a letter to the secretary of the judicial department last month. He had ordered five years rigorous imprisonment for the accused judges apart from a recovery of Rs 1 lakh from each one of them as fine.In his letter justice Karnan said that those accused judges had later sent cops to his residence on several occasions.

In a letter he has said that he wants to continue at the Rosedale complex flat as it serves as his residential place and “make-shift court”.The new chain of events, over the Rosedale complex flat where justice Karnan stays, started when the housing department sent a letter to the secretary of the judicial department last month. In the letter the housing department mentioned that the retired justice is still occupying the flat. The flat, meant for a sitting judge of the Calcutta high court, needs to be vacated. A few days after that the registrar general of Calcutta High Court’s office sent a letter to justice Karnan and the brought the issue to his notice.In a letter to the housing department and the registrar general on August 15, the retired justice wrote that he is aware of the fact that the chief engineer of the housing department has sent an eviction notice to vacate the flat at the Rosedale complex. “The reason assigned by the engineer-in-chief, that the Rosedale Development Pvt Ltd wants to sell the said property presently occupied by me,” he wrote in the letter.Explaining his inability to vacate the flat justice Karnan reasoned that before my retirement he was prevented from attending my court assignments from February 8, 2017 and aggrieved by that he had convicted eight judges of the Supreme Court. “Now the tenanted property serves as my residential place and make-shift court . Hence my occupation at the said site is of paramount importance since valid order is pending for execution wherein the law will surely catch up with the misdemeanors.”Justice Karnan in May last year charged eight apex court judges including the chief justice J S Kheher under the Scheduled Caste/ Scheduled Tribe Atrocities Act 1989 and Amendment Act of 2015. He had ordered five years rigorous imprisonment for the accused judges apart from a recovery of Rs 1 lakh from each one of them as fine.In his letter justice Karnan said that those accused judges had later sent cops to his residence on several occasions. He has also mentioned that a team of psychiatric doctors were sent to his residence to determine if he was suffering from lunacy. “No order has been passed on the doctors’ report. Till such time my occupation is absolutely essential at the said premise (Rosedale complex),”he wrote.The retired justice has mentioned that he is a law-abiding citizen and will not interfere with the rights of the landlord. He said that he is ready to pay the required rent and purchase the property if the landlord is willing to sell the property.
