BAREILLY: In a controversial move, a cleric at the influential Dargah Aala Hazrat seminary here passed a fatwa on Monday asking people to boycott Nida Khan , a triple talaq victim who has been running an NGO for women who too are victims of the divorce practice and nikah halala . Though the copy of the written fatwa uses the name ‘Hinda’ instead of ‘Nida’, a cleric later told media persons that the fatwa has been passed for Nida.Responding to a query by Mufti Mohd Khurshid Alam Razvi , the imam of Bareilly Jama Masjid, an Aala Hazrat cleric, Mufti Afzaal Razvi , wrote while issuing the fatwa, “Halala is mentioned in the Quran. If Hinda does not apologise, she should be boycotted. Nobody should talk or greet her and people should stop eating with her, should not visit her if she is taken ill and if she dies, they should not read her last prayer or let her be buried in a graveyard.” The fatwa was written by the cleric in the presence of Bareilly city qazi Maulana Asjad Raza Khan and TOI has a copy of the document.Nida Khan was divorced by her husband, Sheeran Raza, who is from the family of the head of Aala Hazrat, through triple talaq in 2016, which she had contested in civil court, which had declared the triple talaq as invalid. She had alleged that she had suffered a miscarriage after being assaulted by her husband in 2015. Khan has been highlighting the plight of triple talaq and nikah halala victims ever since, inviting the ire of clerics.Mufti Mohd Khurshid Alam Razvi said, “Nida wants amendment in Sharia while Islamic laws were made by Allah. As Nida has been giving statements against Quran and Hadith, she is dismissed from Islam. If she publicly apologises, she will again become our sister. No Muslim should try to meet her. Any person, including her family and triple talaq victims, who will meet her and do not follow Sharia decision, will stand at the same position as Nida. If any woman has any issue with talaq or other matter, she should approach darul ifta (the council of clerics at the seminary) and follow Islamic laws.”When told that boycotting a person is against the Constitution, Mufti Mohd Khurshid Alam Razvi said, “We have announced a Sharia boycott which is according to Islamic law.”Khan however dismissed the fatwa and said, “Supreme Court in 2014 had ruled that fatwas issued by Sharia courts or clerics have no legal sanctity. I am aware about my fundamental and democratic rights given by the Constitution of India and such fatwas are invalid. Besides, when Sheeran gave me triple talaq, he should have returned my belongings and jewellery and given me mehr which is the norm under Sharia. The clerics should have first taken action against him for not following Sharia instead of inciting people against me. Women do not get justice when they visit these clerics with their problems. People have been exploiting women by misquoting Sharia laws."
