Arrests under SCST Act should be after scientific probe UP minister

LUCKNOW: Less than a fortnight after a host of upper caste organisation staged a Bharat Bandh in protest against amendment in the SC/ ST atrocities act passed by parliament, UP cabinet minister SP Singh Baghel kicked up a fresh row on Thursday saying that case of under this act should not be slapped on an accused without carrying out scientific investigations like DNA finger printing.Speaking to TOI, Baghel said that just like an investigation into a case of murder or robbery, case of Dalit atrocity should also be investigated properly and scientifically.Some slap false charges against innocent: MinI am not speaking against Parliament but then a proper investigation is necessary to ensure that no innocent is sent to jail,” said Baghel, an MLA from Tundla On August 9, Parliament had overturned a Supreme Court order of March 20 concerning certain safeguards against arrest under the SC/ ST law. The restored act ruled out any provision for anticipatory bail for a person accused of atrocities against SC/STs, notwithstanding any court order. It also provides that no preliminary inquiry will be required for registering a criminal case and an arrest under this law would not be subject to any approval.“FIRs can be registered against anyone. BSP national general secretary Ram Achal Rajbhar said that party chief Mayawati had already been pointing out how BJP leaders have and will continue to have an anti-Dalit mind set.SP spokesperson Rajendra Chaudhary said that the BJP ministers needed to clarify their stand on the SC/ST Act. ``All these statements could be part of a BJP strategy ahead of the next general elections,'' Chaudhary said.UP Congress Committee spokesperson, Dwijendra Tripathi said that the statement only exposes the double speak of the BJP and its ministers. “The BJP leadership needs to assess if there is a kind of rebellion from its ministers on the SC/ST act.
