Yogi Adityanath govt invokes ESMA in Uttar Pradesh, bans strike for 6 months

Lucknow: The Yogi Adityanath on Wednesday invoked the Essential Services Maintenance Act (ESMA), prohibiting strikes in all state government departments and corporations for six months. Meanwhile, Section 144 of the CrPC has been imposed in the UP capital by the Lucknow district administration.

As per the order issued by the state government, the prohibitory orders clamped in Lucknow will stay in force till December 1. According to the government spokesman, this has been done in the wake of increasing COVID-19 cases in Lucknow despite all precautions. No permission will be given for any new event without prior information to the district authorities, the state government added. The UP government’s decision to invoke ESMA came after some state government employees unions backed the November 26 strike call given by 10 central trade unions, reported news agency IANS. The ban on strikes will stay till May 2021.

ESMA has been invoked after taking permission from Uttar Pradesh Governor Anandiben Patel. "The State Government is satisfied that it is necessary and expedient in the public interest to do so." “The Governor is pleased to prohibit, for a period of six months from the date of publication of this notification in the Gazette, strikes in any public service in connection with the affairs of the state of Uttar Pradesh and any service under a corporation owned or controlled by state Government and any service under a local authority”, read a notification issued by Additional Chief Secretary Mukul Singhal.

Under ESMA, it is illegal to initiate a strike. Anyone found doing so could be imprisoned for a term which may extend to one year, or attract a fine of up to Rs 1,000, or both. It also arms the police with the right to arrest (without a warrant) anybody found breaching the Act`s provisions. The Yogi government had previously invoked ESMA on May 22, 2020.
