Noose tightens around promoters of illegal colonies

Kuldip BhatiaLudhiana, September 21Advice for officialsEven as the new Congress government contemplates bringing out yet another policy for the regularisation of unauthorised/ illegal colonies in the state in the near future, the Greater Ludhiana Development Authority (GLADA) has asked revenue officials in the five districts under its jurisdiction not to register sale deeds in illegal colonies as per the instructions of the Punjab Government way back in February 2015. Going a step further, the PUDA Additional Chief Administrator, in his office memo (3810 dated August 28, 2017) has sounded a note of caution to the revenue officials that in case sale deeds in unapproved or illegal colonies were registered, they (revenue officials) would be held responsible for the loss caused to the exchequer by way of non-receipt of CLU (change of land use) charges, licence fee and external development charges as well as for unregulated development of colonies. In an office memo (no ACA/GLADA/Ldh(F-gen-213)/7199-7213 dated September 11, 2017) addressed to the Deputy Commissioners of Ludhiana, Moga, Ferozepur, Nawanshahr and Jalandhar (only for Phillaur subdivision), the Additional Chief Administrator of GLADA has drawn their attention to instructions issued by the state government as well as provisions made in Section 20 (3) of the Punjab Apartment and Property Regulation Act 1995 (Amended Act 2014), which lays down that sale deeds of plots/ buildings lying in illegal colonies should not be registered. In the directions issued by the Department of Revenue and Rehabilitation, Punjab (in February 2015), regarding registration of sale deeds, it was mentioned that the malpractice of getting sale deeds registered by the misrepresentation of facts and in violation of provisions made in the Punjab Apartment and Property Act, was continuing.GLADA has advised revenue officials to stop registration of sale deeds of plots and buildings, where such properties have not obtained NOC from the competent authority or where developers have not obtained licences for carving out colonies.
