High court stays arrest of Hindu Mahasabha leaders who set up ‘Hindu court’

Meerut: The Allahabad high court on Monday stayed the arrest of two leaders of Akhil Bharatiya Hindu Mahasabha who were booked by Meerut Police two weeks ago for setting up a “Hindu court” here.Pandit Ashok Sharma, national vice-president of the outfit and Abhishek Agarwal, its Meerut president were booked on September 12 at Brahmpuri police station. The outfit was planning to cover issues like harassment of Hindu women, Hindu marriages, disputes of property or money, and many others.The high court has already sought the response of the UP government over the formation of the religious court while hearing a petition filed by one Ankit Singh, who has called the “Hindu court” illegal. A case under Indian Penal Code's (IPC) section 153 (A) (promoting enmity between different groups on grounds of religion, race, caste and creed) was registered against them.According to the lawyer representing the outfit, a petition was filed against the parallel religious court much before the FIR was filed, and the case was pending in the high court.“The Allahabad High Court has put a stay on the case that was filed against Hindu Mahasabha members for coming up with the first ever Sharia-like Hindu court in Meerut. There is a petition pending in the matter in the court, but even then, Meerut Police filed a case against the outfit’s members in question,” said Rajesh Kumar Srivastava, lawyer for Hindu Mahasabha leaders.Set up with an aim to make decisions on Hindu affairs, and have a parallel court-like system in place just like Sharia courts, the “first Hindu court” had also got its first judge in a ceremony that was held at the outfit’s office on Meerut’s Sharda Road on August 15.Explaining the delay in filing of the FIR, local police had said that they had registered the case based on the inputs from the Local Intelligence Unit (LIU), which took its time.The “court” was set up to deal with matters related to Hindus only.
