POCSOA Court observes 'personal enmity' behind man accused of molesting minor girl

The Special Protection of Children Against Sexual Offences act (POCSOA) court recently while granting bail to a 29-year-old man, who was accused of allegedly molesting a minor girl said, that it appears the case seems to be filed against the accused by the victim's family due to 'personal enmity'. According to the accused, he was playing with the kid and he playfully threw her in the air. Keeping the accused behind bars would not serve the purpose".

The court in its orders held, "Keeping in view the statement of the victim, possibility of accused playing with the victim as usual and the victim getting scared due to throwing her up in the air cannot be ruled out. According to the accused there was a dispute between the victim's grandfather and the accused and so he is implicated and here both the views are possible about the act of the accused. Also the investigation is virtually over. Keeping the accused behind bars would not serve the purpose". According to the accused, he was playing with the kid and he playfully threw her in the air. The child got scared and she came crying to her mother. The child's grandfather, who had fought with the accused in the past, approached the police station and filed a case against the accused. The application was opposed by the prosecution on the grounds that he touch the child in a misappropriate manner.
