Lt. Col. Prasad Purohit trying best to prolong Malegaon blast trial: Special Court

The special court conducting the Malegaon blast trial noted recently that accused Lt. Col. Prasad Purohit was 'trying by hook or crook to prolong the matter' despite the directions of the Bombay High Court to conduct day-to-day proceedings. The court noted this in its roznama which registers the daily proceeding details of a case. Purohit had said in his plea that he needed time to collect some articles to show how fair trial was denied. The court also noted how he had stated in his application that there was no urgency to decide the application as the matter is adjourned by the HC. It also noted that an application was filed by accused BJP MP Pragya Singh Thakur, also seeking time to reply on the media plea.

The special court conducting the Malegaon blast trial noted recently that accused Lt. Col. Prasad Purohit was 'trying by hook or crook to prolong the matter' despite the directions of the Bombay High Court to conduct day-to-day proceedings. The court noted this in its roznama which registers the daily proceeding details of a case. Purohit had sought two weeks time to respond to the intervention sought by journalists in a plea by the prosecuting party, the National Investigation Agency (NIA), seeking an in-camera trial in the case which would bar the media from either attending or reporting on the trial. Purohit had said in his plea that he needed time to collect some articles to show how fair trial was denied. The court also noted how he had stated in his application that there was no urgency to decide the application as the matter is adjourned by the HC. The application by Purohit also stated that interpretation of Section 17 of the NIA Act (under which the NIA had asked for in-camera proceedings) was a subject matter before the HC and that the trial court must wait for the HC's decision on it. Mentioning an oral submission by an advocate appearing for Purohit who told the court that Purohit needs to collect articles published in the year 2008, Judge VS Padalkar stated in the roznama, “After considering the said submission, it finds to me that that by hook or crook accused no. 9 (Purohit) wants to prolong the matter despite the Honorable HC directing to conduct the said matter day-to-day and there is no stay to the recording of evidence.” The court refused to grant two weeks time to him to respond to the media's plea for intervention. Citing an order of the HC in an appeal filed by Sameer Kulkarni, an accused in the case, against unnecessary adjournments in trial, in which the HC had said that if the special court finds that any particular party or advocate is not co-operating with it, it may send a report to the HC, Judge Padalkar directed that the order copy of this roznama be forwarded to the HC to be placed before the HC bench. It also noted that an application was filed by accused BJP MP Pragya Singh Thakur, also seeking time to reply on the media plea. Granting time of one day, Judge Padalkar stated, “This fact brought to your Honour's kind notice as to how the applications are being submitted to prolong the matter for recording of evidence.” An application has been filed by Purohit seeking to expunge remarks in the roznama against him. This plea is yet to be heard
