Mysuru man gets seven years in jail for raping minor

MYSURU: A city court has sentenced a youth to seven years in jail for raping a minor girl in 2012, on Wednesday. Mahadevaswamy of Jayapura hobli was sentenced to seven years imprisonment and Rs 50,000 fine on rape charges and two years in jail for kidnap and Rs 10,000 fine. The girl then turned hostile and claimed all the statements given by her during cross examination is 'false' and didn't accuse husband Mahadevaswamy to save him from legal hurdle. Another accused Ninganna Swamy was sentenced to two years in jail for lending his bike to Mahadevaswamy to take the girl away from her home.Jayapura police had booked Mahadevaswamy on charges of kidnap following complaint by girl's parents but later police booked him for rape of minor girl.Later to escape legal action, the accused offered to marry the girl to which her parents agreed and gave their daughter's hand in marriage to Mahadevaswamy. The girl during cross examination had admitted that she was kidnapped and raped by Mahadevaswamy.The VII additional and district court, however, convicted and sentenced the accused based on statement by the victim during the cross examination.Public Prosecutor Mahanthappa claimed there is Supreme Court directive to consider witness/victim statement during cross examination in certain matters for conviction and in this case this directive has been applied.Meanwhile, the court has ordered to pay 70% of fine amount to the victim.
