Legality of Hookah ban challenged in HC

Nagpur: The prominent city restaurant Chill and Grill has challenged the legality of ban over hookah through filing a writ petition before the Nagpur Bench of Mumbai High Court. He claimed that a business of 25,000 per day is lost due to ban on hookah. Meanwhile the State government had applied ban over Hookah by amending the said Act in 2018, while the petitioner has claimed that the Act is in violation of the Central government. Hence the petitioner has prayed to the court to declare such ban illegal. The petitioner has created a smoking zone in his restaurant as per the Cigarette and Tobacco Act.

Nagpur: The prominent city restaurant Chill and Grill has challenged the legality of ban over hookah through filing a writ petition before the Nagpur Bench of Mumbai High Court. The hearing of the case was held before justices Pradeep Deshmukh and Rohit Dev on Monday. Subsequently the court passed an order to seek reply from secretary of law and justice department secretary of food and civil supplied department and advocate general of State within six weeks through serving the notice on them. The petitioner has created a smoking zone in his restaurant as per the Cigarette and Tobacco Act. Meanwhile the State government had applied ban over Hookah by amending the said Act in 2018, while the petitioner has claimed that the Act is in violation of the Central government. He claimed that a business of 25,000 per day is lost due to ban on hookah. Hence the petitioner has prayed to the court to declare such ban illegal. Adv Sangram Shirpurkar appeared for the petitioner.
