Hubby jailed for not paying maintenance amount, released

Nagpur: In a rare development, the Nagpur Family Court sent a man behind bars for failing to pay maintenance to his wife and two minor kids. "The respondent has failed to clear the arrears of the maintenance though he has a source of income. "If the provision or arrangement of the maintenance is not made, then the person may face starvation and vagrancy," he observed. "He was not ready to perform his responsibility as a father of his minor children and as a husband of helpless wife. The city-based man failed to pay regular monthly amount of Rs1,200 for over three years, which accumulated to Rs1.36 lakh.He was arrested on June 20 and was sentenced to 12 months of imprisonment for defaulting on payments.

The city-based man failed to pay regular monthly amount of Rs1,200 for over three years, which accumulated to Rs1.36 lakh.He was arrested on June 20 and was sentenced to 12 months of imprisonment for defaulting on payments. It was only after his relatives deposited the maintenance amount with the court that the man was released on Thursday.Judge at Family Court No 2, Subhash Kafre, accused the man for neglecting the welfare and well-being of the minor children. "He was not ready to perform his responsibility as a father of his minor children and as a husband of helpless wife. Therefore, this court was required to take coercive measures against the respondent for the rightful, valid and legal claim of the wife and children," he said.He further pointed out that only after adopting coercive measures, the husband deposited the arrears of maintenance which would be useful for basic requirement and necessary expenditure of his children's education. "The respondent has failed to clear the arrears of the maintenance though he has a source of income. Big amount is due against him and he is not ready to clear the same. Therefore, it was necessary to pass order of sentence against him," Kafre said.As the husband failed to deposit dues despite repeated pleas for a long time, the wife moved to the court. The judge then issued arrest warrant against him on June 20 which was served to Lakadganj Police Station, as his residence falls under its jurisdiction. The warrant copies were also provided to the respondent and Nagpur Central Jail superintendent along with Lakadganj police inspector.Elaborating the need to pay regular maintenance to the spouse, the judge observed that maintenance is a basic human right of a person and is granted to keep the soul and body together. "If the provision or arrangement of the maintenance is not made, then the person may face starvation and vagrancy," he observed.
