Insurance claims for stolen vehicles parked in open can’t be denied

There after he presented the papers of the complaint to the company.The company however on November 29, 2017 wrote to the complainant saying his claim was rejected.The insurance company had objected to parking of the vehicle outside covered parking area and said that it violated the clause IV of the terms and conditions of the policy, as was agreed between the company and the consumer.“Considering the facts, we feel the insurance company has been found deficient in providing services to the consumer,” the forum said. Nashik: The Nashik consumer forum has said that insurance companies cannot deny claims for theft of vehicles on the basis that the vehicles were parked in open.Citing the decision of National Consumer Disputes Redressal Commission (NCDRC), the bench unanimously agreed and ordered the National Insurance Company to not only settle the Rs 3.46 lakh claim filed by Sudhir Dhanorkar, but also pay the interest of 10 percent per annum of interest, Rs 7,000 as compensation for mental harassment and Rs 3,000 for the costs incurred.The forum observed that insurance company had rejected the claim on the grounds that the vehicle was not parked in the parking space.“As per the National Commission order, which has asked the insurance companies to settle the claim even in case where windows of cars are left open and keys were attached to the car, the current case also should have been treated as ‘non-standard’ basis and accordingly dealt with,” reads the judgment passed by Sachin Shimpi, president of the bench Milind Sonawane and another member Prerna Kalunkhe-Kulkarni.In the complaint registered with the consumer forum by Dhanorkar on December 15, 2017, he said that they was was parked outside the house on Aug 8, 2017 at 7.00 pm was under insurance cover.
