NASHIK: The district consumer grievances redressal forum has ordered a hospital in the city to compensate a patient Rs 50,000 for performing a surgery without obtaining the consent of the patient or her relatives and without having the necessary infrastructure for ICU in place.Pradnya Pramod Kulkarni had gone to Bhagwati Hospital in Rane Nagar, complaining of chronic stomach pain. She was diagnosed with stones in her gall bladder. She was admitted to the hospital on October 10, 2016 and operated through Endoscopic Retrogade Cholangio Pancreatography (ERCP) in which an incision is made in the bile duct to remove the stones. Kulkarni claimed that the doctor had failed to obtain prior permission for performing the surgery.Kulkarni did not recover even after the surgery and the situation became grimmer by October 13 as she was unable to pass urine. The doctor examined the patient and immediately rushed her to Apollo Hospital, where her relatives learnt that her pancreas had been injured during the previous surgery. About 13 litres of water were removed from the body and the patient was discharged on October 23.However, the stones were still in the body for which Kulkarni went to Mumbai. The specialists decided to conduct a laparoscopy and remove the stones. The operation was successful.Kulkarni claimed that since the doctor was unable to perform the surgery due to lack of appropriate infrastructure, including the ICU, and failed to inform her relatives about the procedures in ERCP, she had to cough up Rs 5.43 lakh. She asked the doctor to compensate but he refused to pay. Accordingly, a complaint was registered with the forum in June 2017.However, the doctor claimed that the treatment was carried out as per protocol and that there was no deviation. Both the patient and her relatives were clearly apprised of the issues.
