“The Allahabad high court had cancelled the bail plea of the main accused and day-to-day proceedings are going on in the case,” he said. However, in my case, no help has come from any of the politicians who lined outside my home after the incident. Mahesh Sharma, Raj Babbar and other leaders had come and said they will ensure good treatment. Sharma had said he would take care of me till I stand on my feet,” Jitendra said.SSP Ajay Pal Sharma said the facts about the “pressure” alleged by the family needs to be verified. NOIDA: The Apple executive’s murder in Lucknow a few days ago is a chilling reminder of a similar excess that took place in Noida in February this year. Jitendra Yadav (27), a gym trainer who was preparing for the title of ‘Mr Uttar Pradesh ,’ is now paralysed due to a shot fired at him by an under-trainee sub inspector, Vijay Darshan, on the night of February 3.Darshan, along with three other constables—Sanjay Tamta, Narendra and Pankaj Singh—had allegedly physically assaulted Jitendra after a tiff and bundled the latter in the back seat of his Scorpio that he was driving towards Sector 122 where he was to drop his two friends — Suneel Jat and Gautam Sardar. However, the argument led to Darshan taking out his revolver and shooting Jitendra in his throat—the bullet pierced his body and his spine.Exactly eight months after that night, Jitendra’s family says they are under pressure for a compromise from the family of the main accused and have lost hopes with the police investigation.Sitting next to his younger brother’s hospital-like bed in his home in Parthala Khanjarpur in Sector 122, Dharmendra Yadav told TOI that the pressure came through their relatives.“They have been trying to press for a resolution by meeting our relatives. It has happened at least three-four times,” he said.Questioning the role of police, Dharmendra said the chargesheet filed by police only names the main accused while no chargesheet has been filed against the other three accused, who continue to serve with UP police.Jitendra’s advocate emphasised that while the FIR was lodged under the stringent Section 307 under which the maximum punishment one can get was life imprisonment, the investigating officer filed the chargesheet only against the main accused Vijay Darshan under Section 308 ( culpable homicide ) of IPC where the maximum punishment is a term which may extend to seven years.“None of the three other accused constables have been named in the chargesheet. The charges against Darshan have been diluted and the accused’s side continues to delay the hearings in the court by making claims like medical issues, absence of lawyer, change of lawyer, etc. While the high court had ordered day-to-day hearings, the same is not happening,” advocate Hariraj Chaudhary told TOI.He compares his case to that of the Apple executive who died in Lucknow.“The UP CM has given a compensation of 40 lakh to the family of slain Vivek Tiwari. However, in my case, no help has come from any of the politicians who lined outside my home after the incident. Mahesh Sharma, Raj Babbar and other leaders had come and said they will ensure good treatment. These promises never came through. Sharma had said he would take care of me till I stand on my feet,” Jitendra said.SSP Ajay Pal Sharma said the facts about the “pressure” alleged by the family needs to be verified. “The Allahabad high court had cancelled the bail plea of the main accused and day-to-day proceedings are going on in the case,” he said.
