Harass case against manager ordered

The manager has been ordered to appear before the court on January 9, 2019.The manager refused to comment when TOI contacted him. Samsung Institute, Sector 62, did not respond to an email sent to the legal head and human resources department. She was sacked on August 9, 2017.In its order on October 24, the court noted that the woman had complained that her appraisal rating in March 2017 was low. She also posted a video on her Facebook wall of an episode at the office in which she was insulted. The woman alleged she was sacked without a valid reason or a prior notice.

Noida: Hearing a petition by a former Samsung employee alleging harassment, the district court has ordered that an employee of the company’s Noida Sector 62 branch be summoned as an accused and booked under Section 354D (stalking).The 25-year-old woman had approached the court in Surajpur in July last year after her complaint was not lodged at the Sector 58 police station despite complaints to the SSP and the SHO.After hearings, the chief judicial magistrate’s court had this June ordered police to submit an investigation report. The woman alleged she was sacked without a valid reason or a prior notice. She also posted a video on her Facebook wall of an episode at the office in which she was insulted. She was sacked on August 9, 2017.In its order on October 24, the court noted that the woman had complained that her appraisal rating in March 2017 was low. She later went on leave, citing health problems but was allegedly called by the human resources team which asked for a medical certificate.“It has been alleged the woman was threatened that failing to provide the medical, proceedings would be initiated against her. The complainant informed the Noida branch managing director. After that, the HR head called the complainant for a meeting where she was humiliated by three employees,” the court said, citing the woman’s complaint.In the dated October 24 order, the court noted that along with the complainant, two witnesses appearing had supported her statements. The court also noted that she had raised this with the company’s internal complaints committee — whose report she submitted to the court as evidence — which had warned her manager, the one who will now be summoned as an accused, and two others.A case under Section 354D was ordered based on an allegation by the woman that the manager had dragged her by the hand. The manager has been ordered to appear before the court on January 9, 2019.The manager refused to comment when TOI contacted him.
