Patna HC orders to ensure timely supply of free study material to students

PATNA: The Patna High Court on Wednesday ordered the chief secretary and principal secretary of the state education department to form a committee and submit a report within a month for ensuring that the students from Class I to Class VIII studying in the government school across state are timely supplied reading and writing material along with uniforms free of cost as per rules before a fortnight of commencement of academic session for the year 2018-2019.According to The Bihar State Free and Compulsory Education Rule, 2012, formed under the Right to Education Act, 2009, every student is entitled to three textbooks, writing materials and uniform for free of cost.The order was passed by the division bench of Chief Justice Rajendra Menon and Justice Rajeev Ranjan Prasad while hearing a public interest litigation (PIL) filed by one Shiv Prakash Mishra . Counsel Dinu Kumar and Ritika Rani appeared on behalf of the petitioner before the bench.Mishra submitted information before the court, sought through RTI that the education department for last several academic sessions had constantly failed to timely deliver study materials to students on which the bench lambasted the Bihar Text Book Corporation BTBC ) saying that it has become a failed entity.The court was also informed that education department placed a work order for supplying the study materials and uniforms for the present academic session, which has almost ended, on August 31 last year, but was yet not supplied and department even had conducted the half-yearly examination.According to the RTI reply sought by Mishra, the education department delayed 76 days for free distribution of study materials and uniforms to students during academic session 2007-2008 and in the next session, the delay period increased to 260 days.For session 2009-2010, department delayed for 228 days while for session 2010-2011, study materials were supplied only after 153 days of commencement of academic session.
