PATNA: The Patna high court on Friday rejected the state government’s appeal against a single bench judgment of the court which had set aside the decision of the Bihar School Examination Board BSEB ) chairman to cancel affiliation of 212 schools after topper scam was unearthed in 2016.The division bench of Chief Justice Rajendra Menon and Justice Rajeev Ranjan Prasad, while hearing a batch of at least 50 petitions, upheld the judgement of Justice Chakradhari Sharan Singh delivered on August 24 last year, in which he had set aside the decision of the BSEB chairman to cancel the affiliation of 212 schools, terming the action as “illegal”.Affiliations were granted to these schools when Lalkeshwar Prasad Singh was at the helm of affairs at the BSEB. He later served notices on these schools, asking them to explain why their affiliations should not be cancelled on the ground of lack of infrastructure and other facilities.In its judgment, the court had observed that it’s not chairman, but a committee of the board which recommends withdrawal or grant of affiliation to any school.“There being no dispute that the matter was not placed before the committee, the impugned decisions of the board of withdrawing/cancelling the affiliations of the schools/colleges, which have approached this court in the present proceedings, are, accordingly, illegal and unsustainable and deserve to be set aside,” Justice Singh had ruled.
