HC prod to DM to remove squatters

PATNA: The Patna high court (HC) on Friday directed the Patna DM, SSP and Patna Municipal Corporation (PMC) commissioner to together chalk out a plan for removing encroachments beneath the flyover near Patna Junction.Hearing a PIL filed by one Ravindra Kumar Karn, a division bench of Chief Justice Rajendra Menon and Justice Rajeev Ranjan Prasad also asked the authorities to submit the plan before it within two weeks. It also sought to know from them what action was taken so far to remove the encroachments.“Prima facie we find correct the petitioner’s contention that squatters are mushrooming leading to congestion of traffic... The Patna City SDM’s court had on September 29, 2017 ordered them to shift out of the densely populated areas, but to no avail.The petitioners were represented by Shweta Pandey, Manisha Pandey and Deepak Kumar. It had also sought to know what action the government intended to take if such activities were not permissible in the area.The Bihar State Pollution Control Board, in its affidavit submitted earlier, has said 94 factories are creating noise and air pollution in the areas. They have also constructed small godowns in the area,” the court observed.Appointment of BHRC chairman: The division bench on Friday directed the state government to expedite the process for appointments of Bihar Human Rights Commission (BHRC) chairman and against the vacancies in other constitutional and statutory bodies in the state.Hearing a PIL filed by the Nagrik Adhikar Manch, the bench gave three weeks’ time to the state government to file a counter affidavit, indicating the steps taken to make these appointments.Manch’s counsel Dinu Kumar said the BHRC chairman’s post had been lying vacant since November 2, 2016.PMC official summoned: Apparently annoyed with the PMC and state government, the HC on Friday summoned the PMC and state officials concerned on August 13 in connection with a matter related to illegal iron chest and almirah manufacturing factories in Sultanganj and Alamganj areas.During the last hearing of the PILs filed by Salimullah and Saroj Kumar on June 20, the HC had ordered the state government and PMC to file counter affidavits within four weeks, stating if the areas fell under commercial or residential category in the Patna master plan.
