PMC told to give Rs 2 crore bank guarantee over waste issue

PUNE: The National Green Tribunal (NGT) bench on Thursday ordered the Pune Municipal Corporation (PMC) to furnish a Rs 2-crore bank guarantee for “performance” of various steps in the next two months to address waste management issues at the Uruli Devachi and Phursungi landfill sites.The order passed by the bench of Justice S P Wangdi and expert member Nagin Nanda stated that the bank guarantee is to be furnished with the Maharashtra Pollution Control Board (MPCB) and will stand forfeited if the PMC fails to perform as assured. The PMC furnished an action plan suggesting various measures over the next one year, but the bench was keen on knowing as to what immediate action was being taken for removal of the legacy waste that has accumulated over the years at the two landfill sites.”The bench noted down some of the steps enumerated by Nimbalkar regarding the legacy waste and went on to pass the order directing the corporation to furnish the bank guarantee. The bench appeared convinced today about the steps we plan to implement over the next two months and waived the fine in favour of the bank guarantee, which we will furnish in the next few days.”The tribunal’s order comes in response to three petitions filed by Bhagwan Bhadale and other residents of Uruli Devachi and Phursungi; the gram panchayat of the two villages and lawyer Vineet Dhanda. The gram panchayat’s petition has, in fact, been transferred from the Bombay high court to the NGT for hearing.On July 11, the green tribunal had directed a show cause notice to be issued to the PMC municipal commissioner as to why action should not be taken against the civic authorities and why a penalty of Rs 2 crore should not be imposed on them for violating its order of November 18, 2017, regarding an action plan for handling waste at Uruli Devachi and Phursungi landfill sites.Sarode said, “The matter was mentioned before the bench on Thursday morning with Nimbalkar and PMC’s deputy municipal commissioner Suresh Jadhav appearing before the tribunal with their senior lawyer P Narayan.
