PUNE: Judicial magistrate first class (JMFC) S M A Sayyed on Friday directed the Central Bureau of Investigation ( CBI ) to file a written say on a complaint by Amol Arvind Kale, an alleged conspirator in the Narendra Dabholkar murder case, that he was illegally assaulted on September 8 by an officer from the Kolhapur SIT while he was in CBI’s custody.The court ordered Kale’s remand in magisterial custody after the CBI filed a report stating that the agency did not require his custody any more.“The police custody of accused Amol Arvind Kale ends today. The investigation is at crucial state. His other co-accused is also being investigated into. Therefore, Amol Arvind Kale may be sent to magisterial custody remand and may be allowed to be taken back to Bengaluru to lodge at Parappana Agrahara jail, Bengaluru after producing him before the principal city civil and sessions judge at Bengaluru,” the report stated.Lawyer Dharmraj Chandel, representing Kale, moved a complaint on behalf of the accused stating that the court must deal with the same in accordance with the obligations set out by the criminal manual.Chandel insisted that the court take the complaint on record and submitted that, “Kale was physically tortured by an officer from the Kolhapur SIT (which is probing the murder of Communist leader Govind Pansare ) despite being in custody of the CBI at its Belapur office in Navi Mumbai.
