Pune: A district court here on Wednesday directed notices in an appeal filed by the Pune Cantonment Board against an order by the lower court in the matter of action against Kayani Bakery.A lawyer associated with the case confirmed the development and said, "The appeal has been posted for a hearing before district judge S B Bahalkar on November 24." Senior PCB authorities and officials from the board's legal department remained tight-lipped about the grounds on which the appeal has been preferred. There was no clarity on whether the appeal has been filed against the joint civil judge senior division's order of November 14 that rejected the PCB's application for rejection of Kayani Bakery 's complaint for want of cause of action or against the order of November 17 that granted an interim injunction restraining the PCB from "obstructing business" and "forcefully closing" the bakery. The lower court had given a week's stay on the interim injunction to enable the PCB to move an appeal. In the case details posted on the website of District Courts, Maharashtra, the subordinate court information, in relation to which an appeal has been preferred by the PCB, shows the case decision date as November 14. When contacted, PCB's law officer S N Kurpe asked TOI to call the board's chief executive officer. D N Yadav, the CEO, told TOI, "I cannot comment on the matter considering that it is sub-judice. It won't be appropriate for me to elaborate on the grounds of appeal."Lawyer Dara Irani, who is representing Kayani Bakery, said, "We have not yet received any notice, but it is possible that the same may have been directed by the court during the latter half of the working hours today (Wednesday). In any case, we have filed a caveat in the matter and the court will hear us."On October 9, the Kayani Bakery was verbally asked to shut down its business following a joint inspection by PCB president Brigadier Rajiv Sethi and senior officials from the board and the defence estate office. The bakery, which is famous across the country for its Shrewsbury biscuits, has remained shut since October 10.
