Meghalaya HC says forced Covid vaccination violates Article 19(1)(g), asks govt to persuade people

The Meghalaya High Court on Thursday said the Meghalaya government to stop forcing people for Covid vaccine and persuade them instead.

The Meghalaya High Court has said that forced vaccination will be considered as a violation of fundamental rights according to Article 19(1)(g) of the Indian Constitution.

According to the court, making vaccination mandatory for shopkeepers, taxi drivers for returning to their work is against the basic spirit of welfare.

The High Court also said in the order that if the employees have got the vaccine, then shops and all business establishments should get a board of `Vaccinated` installed or written. The court has asked the owners of all local taxi, auto-rickshaw and bus services to display the information about the vaccination of drivers, conductors and helpers in public. So that people can take proper decision before taking their services.

Meanwhile, the bench of Chief Justice Biswanath Somaddar and Justice HS Thangkhiyu also said that vaccination is the need of the hour and necessary steps to prevent the spread of corona but the state government cannot take any action which is in accordance with Article 19(1) of the Constitution. ) is a violation of the fundamental right to livelihood.

A suo motu public interest litigation was filed in the court after authorities in many areas asked people like shopkeepers, taxi drivers to undergo vaccination before resuming work.
