Accident victim's family gets 1 crore compensation

CHANDIGARH: The Motor Accident Claims Tribunal granted compensation of around Rs 1 crore to the family of a man who died in an accident. The deceased, Deepak Kumar Jha, worked as deputy project engineer in Prateek Infraproject India Limited. The tribunal also directed the owner and driver of the offending vehicle as well as insurance firm HDFC ERGO General Insurance to pay compensation jointly. The Tribunal directed New India Assurance, Himachal Pradesh to pay Rs 10,527,144 to all three . In other cases, three city residents were granted compensation of more than Rs 1 crore by Motor Accident claims tribunal in a claim petition filed under Section 166 of the Motor Vehicle Act, 1988 in which two persons died in a bus accident on July 10, 2017.

The deceased, Deepak Kumar Jha, worked as deputy project engineer in Prateek Infraproject India Limited. The tribunal directed the owner and driver of the offending vehicle along with the insurance firm, to pay compensation jointly.Family members of the deceased filed the claim petition under Section 166 of the Motor Vehicles Act seeking compensation of Rs 2,00,00,000 along with interest at the rate of 18% per annum. It was stated that the accident took place on August 15, 2016 when Jha was travelling from Jammu to Delhi with his friends Salender Gupta, Sonu Kumar Jha, Ragvinder Jha, Prem Shanker Jha and Basant Kumar Jha in a vehicle driven by Basant Kumar Jha on the left side of the road.As per the claim petition, at around 4.50am, they reached the area near Hotel Haveli, Mohra village on the Ambala-Delhi road, where the driver rammed into a container parked in the middle of the road without any parking signal or light. All the occupants of the vehicle suffered multiple injuries and were shifted to the civil hospital in Ambala Cantt, where Deepak Kumar Jha was declared brought dead.It was pleaded that Deepak Kumar Jha was 30 years of age on the date of the accident and worked as deputy project engineer in Prateek Infraproject India. He earned Rs 70,000 per month. The claimants, his wife, son and parents were completely dependent on his earnings. It was pointed out that the deceased had a promising future and his untimely death had pushed the claimants on the verge of starvation.The tribunal awarded Rs 99,23,200 as compensation to the family members of deceased. The tribunal also directed the owner and driver of the offending vehicle as well as insurance firm HDFC ERGO General Insurance to pay compensation jointly. In other cases, three city residents were granted compensation of more than Rs 1 crore by Motor Accident claims tribunal in a claim petition filed under Section 166 of the Motor Vehicle Act, 1988 in which two persons died in a bus accident on July 10, 2017. The accident took place near Machada Bridge, Bhadash Rampur, District Shimla. The deceased were parents of city residents. One of the three girls who were claimants was a minor. The Tribunal directed New India Assurance, Himachal Pradesh to pay Rs 10,527,144 to all three .
