Surat: Court summons sent through WhatsApp in financial dispute

SURAT: A local court on Thursday considered a summons delivered on WhatsApp as it was showing two blue ticks. The complainant then approached court through his lawyer seeking permission to send the summons through WhatsApp. The court granted permission after which Kumar was sent the summons on his mobile number. Kumar sent a cheque to refund the payment to Rai but the payment on the cheque was rejected when deposited in bank, litigant alleged.Rai then approached a local court and the court issued summons to Kumar. Due to some unknown reason Kumar failed to supply the products when Rai demanded to return the payment.

SURAT: A local court on Thursday considered a summons delivered on WhatsApp as it was showing two blue ticks. The WhatsApp message with delivery notification was produced in court by litigant and it was accepted by the court in a case related to financial dispute.A paper cup and disposable item reseller from Bhathena area of city, Ashish Rai, used to purchase the products from a Jaipur based businessman, Gopal Kumar . The bulk seller in Jaipur supplied the products as per the order from Rai over phone.In a recent transaction Rai paid Rs 1.30 lakh through online transfer for a order placed. Due to some unknown reason Kumar failed to supply the products when Rai demanded to return the payment. Kumar sent a cheque to refund the payment to Rai but the payment on the cheque was rejected when deposited in bank, litigant alleged.Rai then approached a local court and the court issued summons to Kumar. However, Kumar avoided accepting the summon by various means. The complainant then approached court through his lawyer seeking permission to send the summons through WhatsApp. The court granted permission after which Kumar was sent the summons on his mobile number. Later when it was showing two blue tick the litigant approached the court to consider it as confirmed delivery of summons.“Accepting the two blue click delivery notification in WhatsApp the court considered the summons as delivered and issued warrant against the accused,” said the lawyer representing the litigant.(Names changed on request as accused is yet to get arrested).
