THANE: The parents of a 19-year-old boy who died in an accident four years ago have been awarded a compensation of Rs 21.5 lakh. He was his parents’ only son and hence, the demise caused great shock, pain and agony to them as they lost their old-age support as well as his love and affection,” he told the MACT.The legal team appearing for the insurer, Reliance General Insurance Co, contested the claim and submitted that in the case at hand, there was violation of the terms and conditions of the contract of insurance. It was submitted that the container driver was driving with a fake licence.Member of the MACT and district Judge Mrs SA Sinha, after hearing both the sides, noted: “There is no reason to disbelieve the insurance company’s submissions. Therefore, I am inclined to hold that the said driver was holding a fake licence at the time of alleged accident and hence, the insurer has succeeded in establishing the defence that there was breach of terms and conditions of contract of insurance.”“But this the fact that the insured allowed a person who was not holding a valid and effective driving licence to drive the vehicle should not infringe upon the rights of the applicants to recover the amount of compensation from the insurer. Thus, I am inclined to hold that the proper course would be to direct the insurer to first satisfy the wards, and then recover the amount of compensation from the insured,” she directed.The container owner, High Speed Container, did not appear during the trial and the matter was decided ex parte. The judge ordered High Speed Container and Reliance General Insurance Co to jointly pay along with 8% interest from the date of application.
