Dabholkar case: CBI gets 45 days to file chargesheet

The court rejected the plea as it allowed CBI’s plea for extension to file the supplementary chargesheet. A magisterial court on Saturday granted additional time of 45 days to the CBI to file a supplementary chargesheet under the Unlawful Activities (Prevention) Act against two shooters who allegedly opened fire on rationalist Narendra Dabholkar . It rejected the defence counsels’ arguments that the plea should be decided by a special court under the UAPA set up in Pune on par with the special court constituted under the National Investigation Act.Also, the court rejected Andure’s bail plea. Andure, through his lawyer Sanjiv Punalekar, had filed the plea under Section 167 (2) of the CrPC, citing that the agency had failed to file a chargesheet against him within 90 days under the IPC. The court told CBI’s additional superintendent of police S R Singh his plea seeking extension for filing supplementary chargesheet against the shooters— Sachin Andure and Sachin Kalaskar—was allowed for 45 days.The court held that the magistrate had the jurisdiction to decide the CBI plea because the investigations conducted by it came under the “general category”.
