Vadodara: The district Consumer Disputes Redressal Forum in a recent judgement has ordered Gandhinagar-based Pandit Deendayal Petroleum University (PDPU) to refund fees to a former student, who cancelled admission in the university in July 2014 and got only partial refund.Complainant Pruthvi Patel, who lives in Mahavirnagar Society at Karelibaug, had enrolled for MTech course in civil branch in the university in June 2014. Patel had paid Rs 82,500 as fees after his admission was confirmed. On July 14, 2014, Patel applied for cancellation of admission and refund of fees after receiving his immigration visa for the US.On receiving Patel’s application, the university credited Rs 19,500 to his bank account. Patel then approached the university with cancellation and refund rules. According to the university’s rules which are available on its website, the fees paid by the candidate shall be refunded after reduction of Rs 1,000 as administrative charges, provided such vacated seat gets filled up. However, the university did not return Patel’s fees.Patel then approached the consumer forum in Vadodara making allegations against the university that by delaying to return his fees, the university has indulged in immoral business and has faulted in its services. In response to the forum’s notice, the university told the court that Patel had applied for cancellation of fees at the last moment therefore the university has refunded eligible amount of fees.Patel’s advocate then argued before the court that he had applied for cancellation before July 15, 2014, which was the last day of cancellation to get full fees as refund and in that situation the university could have offered Patel’s seat to some other candidate, which it did not.The arguments were upheld by the court and it ordered the PDPU to refund the remaining amount of Rs 55,500 with 8% interest counted from the date of admission of the case. The university was also asked to pay Rs 3,000 to Patel towards legal costs and mental harassment.
