HC notice to Centre, state for ignoring procedure during widening of NH 50

The petitioners submitted that “the notification was published, proposals were invited for consultancy services for Upgradation of Nanded to Jalkot section of NH-50 from KM/1/900 to KM 67/852 to two lanes configuration (Nanded-Usman Nagar-Kandhar-Jalkot- Udgir- Bider- Gulbarga- Vijayapur-Hospet). Aurangabad: The Aurangabad bench of the Bombay high court has ordered notices to the state, the central government as well as National Highways Authority of India and a contractor for beginning construction of a road in Nanded district without due procedure to acquire properties of villagers in Lalwadi of Kandhar taluka in Nanded district. The respondent authorities did not pay compensation on acquired lands and houses to the petitioners and that they had not conducted measurement of these properties, Anerao said.They also pointed out that “respondent no 9 (Executive Engineer, National Highway Division Nanded), prepared the land acquisition plan for NH No50, Nanded to Jalkot (Km 0+000 to Km 65+952) but till today has not implemented it and without any notice acquired the petitioners lands for construction of national highway 50.’’ The next date of hearing is January 18, 2019.Datta Kerba Bargale (48) and 11 other farmers and residents of Lalwadi approached the high court through lawyer Pandit Anerao seeking directions to 14 different authorities including the state government and the central government, to follow due procedure and guidelines prescribed in the National Highways Act to acquire lands and houses of various survey/Gut numbers in the village for widening National Highway 50 from Nanded to Jalkot in the state.“Land of various survey/gut numbers of Lalwadi village were liable to be acquired..
