SC stays NGT order asking state govt to take over forest land in possession of Mula Education society

The SC said, “In the meantime, there shall be a stay on the operation of impugned order of the National Green Tribunal dated 1 March 2019, and of further proceedings before the National Green Tribunal. The matter came up for hearing before Justices D Y Chandachud and Hemant Gupta.While granting permission to file an appeal, the SC ordered issuance of notices returnable in six weeks. Aurangabad: The Supreme Court on Friday stayed the National Green Tribunal ( NGT )’s order asking the state government and the forest department to take over about 120 acres of forest land leased out to Mula Education Society, Sonai, in Ahmednagar district in 1985.The NGT had on March 1 directed the forest department to take possession of the land leased to the education society in accordance with the Forest Conservation Act, 1980.The society had approached the Supreme Court through lawyers Kapil Sibal, Abhishek Manu Singhvi and others. The matter came up for hearing before NGT chairperson Justice Adarsh Kumar Goel, judicial members Justices S P Wangdi and K Kamakrishnan who ordered the authorities to take over the land forthwith and asked them to furnish an action taken report..
