Summary:

The Constitution says that depending on the geographical nature and population of the state, reservations maybe decided. Tamil Nadu has 69% caste-based reservations.”Congress spokesman Abhay Dubey argued that chief minister Kamal Nath is filing a caveat mentioning the ninthe schedule of the Constitution. “Three CMs of the BJP belonged to the OBC category but none could take a step like CM Nath,” said minister for mineral resources Pradeep Jaiswal, who belongs to the OBC community. Bhopal: State Congress on Friday claimed that the Kamal Nath government can implement its 27% reservation for OBCs, despite the 1992 Supreme Court nine-judge bench ruling that put a ceiling on caste-based reservations at 50%.If the Congress government here implements the OBC reservations at 27%, then caste-based reservations would go up to 63% in the state. But Abhay Dubey said that based on the OBC population of the state which is above 50%, the reservations can be implemented under ninth schedule provisions.State Congress and ministers of the Kamal Nath government are also confident that 27% reservations will be implemented..
