Realty company asked to refund Rs 28cr to plot buyers for project delay

NEW DELHI: The apex consumer commission, NCDRC, has ordered a Chandigarh-based real estate firm to refund about Rs 27.5 crore to 40 plot buyers in residential project in Mohali . It had also directed the builder to pay Rs 35,000 to Rs 50,000 as litigation fee to the buyers besides compensation, which ranged between Rs 1 lakh and Rs 3 lakh. The commission had also dismissed the builder’s plea that the buyers were not “consumers” since these were “purchased for future gain”. The cases relate to the IREO Hamlet project by the developer in Sector-98 in Mohali, part a mega project.The state consumer commission had ordered refund of the amount and 12% interest compounded quarterly in 39 out of the 40 cases. It said the delay in the possession is admitted and no legal possession can be offered without a completion certificate while referring to official submission that the project got partial completion certificate only in June 2017..
