SC notices to civic body over demolitions in central part of city

The major affected areas by the IMC’s demolition and road widening drive are Nayapitha, Machhi Bazaar, Kadaavghat, Raoji Bazaar, Silawatpura. This regulation states that existing buildings on proposed roads could not be demolished in the Central part of the city, until fresh application for building permission is submitted by the owner before the IMC.However, the high court rejected the petition upholding the IMC’s stand that the demolition in the central part of the city was being done as per the master plan of 1991. Indore: The Supreme Court on Monday issued notices to Indore Municipal Corporation in the petition challenging demolition activity in central part of the city.The petition has been filed challenging division bench of high court at Indore order, which had dismissed the petition filed by residents.The residents had prayed that as per section 6.3 regulation 18 of master plan, their houses at Nayapitha could not be demolished by the IMC. Arguments over the grant of interim relief will be made before the court in the next week.The petition at the SC has been filed by the same petitioners, Abhay Shukla and Abdul Samad, who had moved the high court seeking relief through the regulation in the master plan.The petition filed by them at the SC has sought an interim relief of stay on all demolition activity in the central part of Indore. And since the road along with demolition as being done was not ‘proposed’ road, the regulation did not apply to it.At the apex court, the matter was heard by vacation bench of Justice S Abdul Nazeer and Justice Indu Malhotra, who directed for notices to be issued to both IMC and the town and country planning department on the petition and on the prayer of interim stay..
