Cabinet nod likely for bill to restore prearrest bail

LUCKNOW: The UP cabinet is likely to clear a bill that will be moved in the assembly to restore the provision of anticipatory bail in the state. Since then, persons seeking a stay on their arrest have to approach Allahabad high court or Supreme Court. The matter is expected to come up before the cabinet on Tuesday.The provision of applying for anticipatory bail in UP was revoked in 1976. In July this year, UP government had informed Supreme Court that the provision would be restored at the earliest. Earlier, a PIL had been filed in Supreme Court by advocate Sanjeev Bhatnagar who said that the lack of anticipatory bail provision resulted in denial of constitutionally guaranteed rights to citizens and contradicts Article 21 of Indian Constitution which refers to protection of life and personal liberty.A senior official said that UP witnessed massive protests against Indira Gandhi government during Emergency after which the provision for anticipatory bail was removed and article 438 of criminal procedure code withdrawn through an act..
