Summary:

The divisional commissioner has to submit a report to the principal secretary, revenue and forest department, within eight weeks. He concluded that the SDO’s October 28, 2009, order was infructuous. The judges said the manner in which the district collector bypassed the HC order and set aside the demolition order, which was already withdrawn, called for a very serious probe. “Thus, it appears that no adjudication was made on the question of Shri Nirav Modi carrying out illegal construction of 695 sq metres,’’ it added. The court “by way of illustration” referred to Modi’s case.Modi was permitted 376 sq metres in Kihim but he constructed on 1,071 sq metres. The divisional commissioner’s probe has to “ascertain in what manner action has been initiated’’ on the “ground of violation of CRZ and/or construction being carried out’’ without permission or in violation of permission granted..
