RERA applies only if work is ongoing: Gautam Chaterjee

"In the present case, the project work has been completed and the building occupied by the allottees since 2012-13 and thereafter the building is under a status quo. Moreover the building has been occupied before the commencement of the RERA act, therefor no directions can be passed for registration under provisions of Section 3 of the RERA act. THE ORDERWhile passing order, Gautam Chaterjee, the MahaRERA chairman, noted, that there are two requisites for the applicability of the Section 3 (registration), it applies to only those projects where construction work is ongoing and for which completion certificate has not been issued Thus it cannot be treated as an ongoing project under the provision of section of the Act," read Chaterjee's order.
