Summary:

The Supreme Court on Wednesday came to the rescue of top officials of the Maharashtra Housing and Area Development Authority (Mhada) facing an order of the Bombay High Court directing criminal prosecution to be launched against them in an alleged scam running into Rs 40,000 crore. The Mhada which had approached the Court last week told the bench of Justices RF Nariman, Surya Kant and V Ramasubramanian on Wednesday that the order was passed without hearing them. Mhada disputed this figure and claimed that FIR has been registered against the defaulting developers and land measuring 6191.89 square metres has been surrendered back to the state. The bench issued notice on the petition and stayed the HC order. Surrender of surplus land was a mandatory condition attached to the issuance of NOC and this disclosed collusion of Mhada officials..
