Income tax commissioner tenders unconditional apology for contempt of court

PATNA: The principal commissioner of Income Tax (2) KK Srivastava , after appearing physically before the Patna high court on Wednesday tendered his unconditional apology for collecting tax of Rs 1.81 crore from Krishna Singh by violating court’s order.Sirvastava appeared before the division bench of Chief Justice Rajendra Menon and Justice Rajeev Ranjan Prasad to tender his apology after which the contempt petition filed against him was disposed.A taxation dispute had arose between the IT department and Singh after which she had moved before the high court for relief.While hearing her petition, the division bench of the Chief Justice Menon and Justice Anil Kumar Upadhyay , on December 20 last year ordered that the department should release the bank account of the petitioner as she was willing to pay 20% of the disputed tax amount.However, the department just after eight day of court’s order, recovered the entire disputed amount after seizing the savings bank, fixed deposits and other financial transactions of the petitioner followed by which she filed a contempt petition on which hearing took place on Wednesday.The court, furious over the actions of the department, ordered Srivastava to undo whatever actions they have taken till now against the petitioner by violating the court’s order.While Ajay Kumar Rastogi represented the petitioner before the court, advocate regenral Lalit Kishore represented the state government and the IT department was represented by Rishi Raj Sinha..
