SC sets aside NGTrsquos order imposing Rs 1cr fine on MPCB

Since the committee comprised members from the Central Pollution Control Board and National Environmental Engineering Research Institute, it was not solely in the hands of the MPCB to stick to the time schedule mentioned in the (National Green Tribunal) order dated July 17, 2018. Therefore, we expect the MPCB to take immediate steps, as stated in the aforesaid affidavit and carry out the directions passed by the National Green Tribunal from time to time, as soon as possible.”Supriya Dangre, one of the lawyers representing the MPCB, told TOI, “The state pollution regulator had filed a detailed affidavit enumerating the steps taken by an MPCB expert committee from time to time to carry out the NGT’s directions.” For these reasons, we allow this appeal (by MPCB) partly and set aside the order of the tribunal in so far as it imposes penalty of Rs1 crore upon the MPCB as well as the direction regarding personal appearance of the member secretary of the MPCB.”The bench, however, said, “The issue being dealt by the tribunal is of great importance as it is dealing with the ambient air quality in Mahul village, Ambapada in Mumbai, and is adversely affecting the health of the inhabitants there. Pune: The Supreme Court on Wednesday set aside an October 25 order of the National Green Tribunal’s principal bench in Delhi, imposing Rs1 crore fine on the Maharashtra Pollution Control Board for not following the tribunal’s directions over the pollution caused by industrial units at Mahul village in Ambapada, Mumbai.“We have noticed that the tribunal has itself constituted a team comprising senior scientists, engineers of Central Pollution Control Board, National Environmental Engineering Research Institute and MPCB (Maharashtra Pollution Control Board) and it is this committee which was to take further steps for carrying out the directions of the tribunal,” the SC bench of Justice A K Sikri, Justice Ashok Bhushan and Justice S Abdul Nazir said in its order on Wednesday.The bench said, “It is undisputed that the committee was constituted..
